These Terms apply to all use of and processing of personal data carried out by Mashe in connection to your use of the Partner App Lite app. By downloading Partner App Lite, you acknowledge that you have read and understood these Terms.
In these Terms:
“Mashe App” means a digital application provided by Mashe to natural and legal persons for ordering products and services from Mashe’s Partners.
“Mashe Service” means both Mashe App and Mashe website located at mashe.delivery for natural and legal persons to order products and services from Mashe’s Partners.
”Mashe Customer” means a user who has placed an order with the Partner through the Mashe Service.
“Partner” means a partner who has signed an agreement with Mashe and who offers its products and delivery services, if applicable, through the Mashe Service.
“Partner App Lite” means a digital application provided by Mashe for the use of its Partners to collect and handle orders placed by Users through the Mashe Service.
“Partner Content” means the content provided by Partner in connection with the Mashe Service. Such content may include data, information, feedback, suggestions, text, content and other materials that is uploaded, posted or otherwise transmitted or stored in connection with or relating to the Partner App Lite.
“User”, ”You” means a natural or legal person using the Partner App Lite.
”Mashe”, ”us”, ”we” means: Mashe Delivery Ltd., acting as the sole data controller.

Mashe shall provide User with the Partner App Lite to enable Partner to handle each order placed by the Mashe Customer with the Partner through the Mashe Service and to make the collecting and packing of the items in the Mashe Customer’s order more efficient and easier.
You have a limited, non-exclusive, non-transferable, and non-sublicensable right to use the Partner App Lite in the form offered to You by Mashe from time to time solely for the purposes set out herein. The license granted to the User for the iOS Mashe App downloaded from Apple’s App Store is further limited to a license to use the Mashe App on any Apple-branded products that the User owns or controls and as permitted by the Usage Rules set forth in the App Store Terms of Service and these Terms.
In order to use the Partner App Lite, the User must create a user account by following the registration instructions in the Partner App Lite. The User shall ensure that any user account credentials and equivalent information required to access the user account of the User are kept confidential and used in a secure manner not accessible by third parties.
Where it is suspected that any unauthorized person has become aware of a User’s user account credentials or has access to the user account of the User, the User shall immediately inform Mashe thereof. The User shall be responsible for any use of the Partner App Lite and any activity under the user account of the User.
The User shall defend, indemnify, and hold harmless Mashe from and against any claims, actions or demands, including without limitation reasonable attorneys’ fees, arising or resulting from all claims arising from the User’s breach of these Terms.
All rights in and to the Partner App Lite, Mashe Service and its components will remain with and belong exclusively to Mashe. The User and Partner shall not (and shall not allow any third party) to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code or sell, assign, sublicense or otherwise transfer any right in any software. Mashe does not grant any license or right to use any trademark of Mashe other than in connection with the Partner App Lite. Partner shall comply with any notices regarding the use Mashe publishes in connection with the Partner App Lite. The User agrees not to use the Partner App Lite to develop a competing product or service.
Mashe reserves the right to access the account of the User in order to provide technical support or updates. Mashe may provide technical support services, through email or otherwise, in accordance with standard practice.
Mashe shall observe the care of a prudent service provider. However, the Partner App Lite may be temporarily unavailable for scheduled maintenance or for unscheduled emergency maintenance, either by Mashe or by third-party providers, or because of causes beyond the reasonable control of Mashe. Mashe reserves the right to discontinue the Partner App Lite temporarily for urgent reasons of which Mashe shall give notice promptly.
The Partner App Lite is provided on an "as is" and "as available" basis. Mashe does not warrant that the Partner App Lite will function in an uninterrupted, timely, secure, error-free or virus-free manner, nor does it make any warranty as to the results that may be obtained from use of the Partner App Lite. The Partner understands and accepts that Mashe may develop the Partner App Lite and they may get new features or the existing features may develop during the time the Terms are valid.
Partner’s obligations relating to processing of personal data of Mashe Customers is defined separately under the contract between the Partner and Mashe and shall apply in addition to these Terms as applicable.
The personal data collected and processed by Mashe can be divided into two general data categories: User Data and Analytics Data.
User Data is personal data collected directly from You. Mashe may collect User Data from Users when Users register to and use the Partner App Lite.
The following personal data collected and processed by Mashe is necessary in order for a proper performance of the contract between You and Mashe as well as for Mashe’s legitimate interest and for the compliance with legal obligations.
When You register to the Partner App Lite and create a user account, You need to provide Mashe with a username and password. When You contact Mashe, we also collect the information You provide when contacting us, e.g. by phone or in email or chat correspondence with us.
Although we do not normally use Analytics Data to identify You as an individual, You can sometimes be recognized from it, either alone or when combined or linked with User Data. In such situations, Analytics Data can also be considered personal data under applicable laws and we will treat such data as personal data.
We may automatically collect the following Analytics Data when You visit or interact with the Partner App Lite:
We use various technologies to collect and store Analytics Data and other information when the Users visit the Partner App Lite, including cookies and web beacons.
Cookies are small text files sent and saved on Your device that allows us to identify visitors of the Mashe Services and facilitate the use of the Mashe Services and to create aggregate information of our visitors. This helps us to improve the Mashe Services and better serve our Users. The cookies will not harm Your device or files. We use cookies to tailor the Mashe Services and the information we provide in accordance with the individual interests of our Users.
We process Your personal data for the following purposes:
Mashe stores Your personal data securely. We will take steps to ensure that the personal data receives an adequate level of protection in the jurisdictions in which they are processed. We provide adequate protection for the transfers of personal data through a series of agreements with our service providers.
We only share Your personal data within the organization of Mashe if and as far as reasonably necessary for the purposes of these Terms.
We do not share Your personal data with third parties outside of Mashe’s organization unless necessary for the performance of the service, legal reasons, or with your explicit consent.
Mashe does not store Your personal data longer than is legally permitted and necessary for the purposes of providing the Partner App Lite or the relevant parts thereof.
You have the right to access, rectify, or request deletion of your personal data. You may also withdraw your consent at any time free of charge. The rights may be used by sending a letter or an e-mail to us on the addresses set out above.
In case the User considers our processing of personal data to be inconsistent with the applicable data protection laws, the User may lodge a complaint with the local supervisory authority for data protection of the User’s country of domicile.
We use administrative, organizational, technical, and physical safeguards to protect the personal data we collect and process. Should despite of the security measures, a security breach occur, we will inform the relevant Users and other affected parties as soon as possible.
